These terms and conditions govern your use of the End of Life Memorials website and platform located at www.endoflifememorials.co.uk ("the Platform"). By accessing or using the Platform, you agree to be bound by these terms. If you do not agree with any part of these terms, you must not use the Platform.
The Platform is operated by End of Life Memorials ("we", "us", "our"). We reserve the right to update these terms at any time. Changes will be posted on this page with an updated revision date.
You must be at least 18 years of age to create an account on this Platform. By registering, you confirm that the information you provide is accurate and complete, and that you will keep it up to date.
When you create an account, you are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately if you become aware of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.
We reserve the right to suspend or terminate accounts that violate these terms, contain fraudulent information, or are used in a manner that we consider harmful to the Platform or its users.
The Platform offers a 7-day free trial upon registration. After the trial period, a monthly subscription of £4.99 is required to maintain full access to the Platform's features.
All payments are processed securely through Stripe. We do not store your payment card details on our servers. By subscribing, you authorise recurring monthly payments until you cancel your subscription.
You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. No refunds are provided for partial billing periods.
If a payment fails, a 14-day grace period will apply, during which you retain access. If payment is not received within the grace period, access to the Platform's features will be restricted.
As a registered user, you may create a personal memorial page containing text, photographs, and videos ("Content"). You retain ownership of all Content you upload to the Platform.
By uploading Content, you grant us a non-exclusive, royalty-free licence to store, display, and distribute that Content solely for the purpose of operating the Platform and providing the memorial service.
You are responsible for ensuring that any Content you upload does not infringe the intellectual property rights of any third party, does not contain unlawful material, and does not violate the privacy or dignity of any individual.
You may invite guests to contribute memories, messages, photographs, and videos to your memorial page. All guest contributions are subject to your approval before they are published.
Guests who contribute content grant both you and us a non-exclusive, royalty-free licence to display that content on the memorial page. Guests retain ownership of their original content.
We are not responsible for the content submitted by guests. As the memorial owner, you are responsible for reviewing and approving all guest submissions before publication.
Members of the public may apply to leave messages on a memorial page. These applications are subject to your review and approval. You have sole discretion over which public applications to accept or reject.
The Platform includes a feature allowing a designated EOL Administrator to declare the memorial owner's passing. Upon such declaration, the memorial page transitions to a public tribute page, accessible to anyone with the link.
You are responsible for designating a trusted individual as your EOL Administrator. We are not responsible for any actions taken by your designated administrator.
You agree not to use the Platform to:
We reserve the right to remove any content and suspend or terminate any account that violates these terms, without prior notice.
The Platform, its design, features, and all related intellectual property (excluding user-uploaded Content) are owned by End of Life Memorials. You may not copy, reproduce, or distribute any part of the Platform without our written consent.
We take your privacy seriously. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal data.
The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, availability, or suitability of the Platform for any particular purpose.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of data, loss of revenue, or emotional distress.
Our total liability to you for any claim arising from these terms or your use of the Platform shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.
You agree to indemnify and hold harmless End of Life Memorials, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your Content, or your violation of these terms.
You may close your account at any time by contacting us. Upon account closure, your Content will be removed from the Platform within a reasonable period, subject to any legal obligations to retain data.
We may terminate or suspend your account at any time, with or without notice, for conduct that we believe violates these terms or is harmful to the Platform, other users, or third parties.
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
